Terms and Conditions
Effective from May 1 2024
Parties and Account Ownership
The SupremeStay hotel management system and booking platform (hereinafter called "the System") is provided by SupremeStay Global AB (hereinafter "SupremeStay"), a company registered in Sweden. The subscription holder and account owner (hereinafter called "the Client") is the person or entity whose information was used during registration. If registered on behalf of an employer, the employer shall be the account owner. In case of ownership disputes, SupremeStay reserves the right to request documentation to determine the rightful owner and may disable accounts until resolved.
Acceptance of Terms
The Client accepts these terms and conditions during registration by checking the required box. SupremeStay may modify these terms periodically, and the Client's continued use constitutes acceptance of any changes.
Scope and Use
The subscription allows the Client to use the System for its intended hotel management purposes only. Subscriptions cannot be shared or used for processing data for others. Usage limits on bookable objects or other metrics must be observed. Abusive use may result in termination and liability for damages.
Payment and Billing
Billing occurs monthly, deducting subscription fees and usage charges from the Client's account balance. Accounts with a negative balance for over 10 days will be locked. If the balance remains unpaid for 60 days, the account may be terminated. Payment reminders will be provided.
Term and Termination
The Client may use the System as long as the account balance is positive. Prepaid fees are non-refundable. SupremeStay or the Client may terminate the account after 60 days of a negative balance or as per cancellation policies.
Customer Data
The Client owns all data entered into the System. Reservation data will be retained for at least 18 months after check-out unless deleted earlier by the Client. Upon termination, the Client can export data for a limited period before deletion. The Client consents to SupremeStay engaging sub-processors to handle data under appropriate safeguards.
Service Operability
SupremeStay endeavors to maintain operational stability but does not guarantee uninterrupted service due to factors outside its control like power outages, equipment failures, etc.
System Changes
To provide optimal service, SupremeStay may adjust or update the System, which may require temporary downtime. Core hotel management functionality will be maintained. Price increases will be communicated in advance unless due to unforeseen circumstances.
Intellectual Property
The System and all associated intellectual property rights belong solely to SupremeStay. SupremeStay may transfer rights and obligations to third parties who will continue providing services under these terms.
Client Obligations
The Client is fully responsible for all transactions conducted through the System and for ensuring data accuracy. The Client must not misuse the System or adversely impact other users. The Client's sole remedy for System issues is to discontinue use.
SupremeStay's Obligations
SupremeStay endeavors to provide reliable service but makes no warranties, express or implied. SupremeStay is not liable for third-party applications, content or services accessed through its System, nor for transactions between the Client and third parties.
Disclaimer and Limitation of Liability
SupremeStay disclaims liability for any direct damages incurred from using its services. SupremeStay, its affiliates, partners and third parties are not liable for punitive, consequential or other indirect damages related to System use, including but not limited to lost profits, data, goodwill, personal injury or property damage. SupremeStay does not guarantee the accuracy of data provided by third parties via the System. The Client solely bears responsibility for reservations, room listings, pricing, tax compliance and any warranties made to guests. SupremeStay disclaims liability for outages, overbookings or events beyond its control.
Channel Manager
The Client is responsible for accurately mapping room types and ensuring rates and availability are properly synchronized across booking channels. SupremeStay is not liable for income losses due to incorrect channel data. The Client accepts full responsibility for any overbookings across channels.
Payments
SupremeStay facilitates payment processing through third parties but never operates as the merchant of record. SupremeStay disclaims liability for any charges to guests, including for no-shows or cancellations.
Data Protection
SupremeStay employs reasonable safeguards to protect client data and processes data only as needed to provide services. Client data may be disclosed if relevant to service provision. The Client is the data controller, and SupremeStay is the data processor under applicable privacy laws like GDPR. The Client must obtain consent, honor data requests, and lawfully process personal and guest data.
Governing Law and Disputes
These terms shall be governed by Swedish law. Any disputes will be resolved through the courts of Sweden. The English version of these terms takes precedence over any translations provided.
